Terms and Conditions

1. Acceptance of Terms

By downloading, accessing, or using Luxgift ("the App"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the App.

2. Eligibility

You must be at least 18 years of age to use Luxgift. By creating an account, you confirm that you meet this requirement and that the information you provide is accurate and complete.

3. Accounts

You are responsible for maintaining the security of your account credentials. You agree not to share your login details or allow others to access your account. Luxgift is not liable for any loss resulting from unauthorised access caused by your failure to safeguard your credentials.

4. Fan Gifting

Fans may browse creator wishlists and purchase items as gifts. By completing a purchase, you agree that:

  • All transactions are final. Refunds are subject to the return policy of the underlying retailer.
  • Luxgift acts as a facilitator only and is not a party to the transaction between the fan, the retailer, and the creator.
  • You will not use the gifting functionality for any fraudulent, abusive, or unlawful purpose.

5. Creator Programme

Creators accepted into the Luxgift programme agree to additional terms set out in the Creator Agreement, which forms part of these Terms. Key conditions include:

  • Creators must maintain an active public profile on at least one supported social platform.
  • Creators receive a revenue share on gifts received, as specified in the Creator Agreement.
  • Luxgift reserves the right to suspend or terminate a creator's account for violation of these Terms or the Creator Agreement.
  • Creators are responsible for reporting and paying any applicable taxes on earnings received through the platform.

6. Prohibited Conduct

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable law or regulation.
  • Attempt to gain unauthorised access to any part of the App or its infrastructure.
  • Post, upload, or transmit content that is defamatory, obscene, or infringes the rights of any third party.
  • Manipulate, scrape, or reverse-engineer the App or its content.
  • Create fake accounts or misrepresent your identity or affiliation.

7. Intellectual Property

All content, trademarks, and materials within the App are owned by or licensed to Luxgift. You may not reproduce, distribute, or create derivative works without our prior written consent. You retain ownership of content you create, but grant Luxgift a non-exclusive, royalty-free licence to use it in connection with operating and promoting the platform.

8. Third-Party Services

The App may contain links to or integrations with third-party services (including retailers and payment processors). Luxgift is not responsible for the content, policies, or practices of any third party. Your use of those services is governed by their own terms.

9. Disclaimers

The App is provided on an "as is" and "as available" basis without warranty of any kind. Luxgift does not warrant that the App will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

To the fullest extent permitted by law, Luxgift and its affiliates, officers, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App or inability to use it.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via the App or email. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
